Defective Product Claims
As a consumer, you have a right to use products that have been tested and proven safe for it's intended use. Manufacturers have a responsibility to provide safe merchandise with clear safety labeling. Our legal system deems a product "defective" if it causes injury as a result of a poor or flawed construction, inadequate labeling, or using it as it was intended to be used. If you have suffered an injury because of a defective product, you have a right to bring a product liability claim against the company who manufactured the product. The manufacturer can then be held financially responsible for your personal injury and/or the damage caused by their product. In some cases, the store that sold the product to you could also be held liable for your damages.
If you have a product liability case, contact our office as soon as possible. To ensure your rights, it is very important that you preserve the product that caused the harm just as it is. Never try to fix or manipulate it in any way. The product is our most valuable piece of evidence. Tampering with the product could cause you to lose your case or interfere with your ability to receive a fair settlement. Save purchase receipts from the product, if applicable, and take photographs. If necessary, as your attorney, Donald Edgar can petition the court to have the product preserved.
